                                             Sub- non sanction of provisional pension to officials retired
                                                          On superannuation/family pensioners when official
                                                           Dies while in service-reg


Respected Sir,
                             
                                                  It was brought to the notice of this association that recently rules are not being followed by Divisional authorities while sanctioning pensions due to which pensioners are suffering after retirement by not getting pension even after a lapse of six months.

1.      As per rule 58 of CCS [RP] 1972 RULES pension papers should be prepared one year before the date of retirement.

2.      As per rule 61 of CCS [RP] RULES 1972 form5, form-7 covering letter in form8 along with service book has to be submitted not later than 4 months before retirement on superannuation and not later than 3 months from submission of form-5 in other cases.

       3. As per rule 64 of CCS [RP] RULES 1972 provisional pension should be sanctioned to pensioners retired on superannuation by HEAD OF THE OFFICE in the absence of intimation from ACCTSOFFICER. HEAD OF OFFICE SHOULD ENSURE THAT RETIRED PERSON GETS PROVISIONALPENSION IN TIME.




4.      As per rule 69 even officials retired on superannuation against whom court cases are pending or on suspension before retirement should be sanctioned provisional pension.

5.      If any govt. servant dies while in service as per rule 80[A] [3] PROVISIONAL PENSION TO FAMILY PENSIONER SHOULD BE SANCTIONED FOR 6 MONTHS BY HEAD OF THE OFFICE.

                                             ALL THE ABOVE RULES CLEARLY MENTIONED THAT GRANTING PROVISIONAL PENSION IS MANDATORY. BUT UNFORTUNATELY NONE OF THE DVNL. AUTHORITIES ARE FALLOWING THESEVRULES BECAUSE OF WHICH RETIRED OFFICIALS ARE BEING DEPRIVED OF THEIR LEGITIMATE RIGHT AND SUFFERING MONTHS TOGETHER WITHOUT PENSION AND GRATUITY.

                                  AS PER THE RULES MENTIONED ABOVE PENSION PAPERS ARE TO BE PREPARED ONE YEAR BEFORE SUPERANUATION AND AFTER COMPLETING THE PROCESS ALL THE PAPERS ARE TO BE SUBMITTED TO ACCOUNTS OFFICE NOT LATER THAN 4 MONTHS. BUT UNFORTUNATELY THIS IS BEING TOTALLY IGNORED AND PENSION PAPERS ARE BEING FORWARDED TO ACCOUNTS OFFICE ACCORDING TO THEIR WISH EVEN AFTERRETIREMENT BECAUSE OF WHICH PENSIONERS ARE SUFFERING LOT DUE TO DELAY IN GETTING PENSIONERY BENEFITS.

                                    As such KIND CPMG IS REQUESTED TO ISSUE SUITABLE INSTRUCTIONS TO ALL DVNL. HEADS TO FALLOW CCS [RP] RULE 1972 STRICTLY AND HELP OFFICIALS RETIRING AFTER GIVING LONG SERVICE IN THE DEPARTMENT.
