This is regarding
judgements delivered byhon’ble CAT HYDERABAD in r/o grant if INCREMENT & DA
DUE ON 1ST JULY TO THOSE WHO RETIRED ON 30TH JUNE AND
REVISE PENSION AND DRAW ARREARS.

pensioners who retired on 30th june filed cases through our
association in CAT HYD for grant of increment and DA due on 1st july
and revise pension and pay arrears. the cases were delt by sri. B.GURUDAS,RETD
IPOS,& SRI.M. VENKANNA,RETD PA, ADVOCATES. after completion of process
judgements delverd by hon,ble judges in our favour,copies of which were already
sent to your presence through govt.lawyer as you are also one of the respondent
in these cases. list of particulars of cases is enclosed.
I woud like to bring to your kind notice
that already DEPARTMENT FILED CASES questioing the judgements in similar case
in hon’ble SUPREME COURT THROUGH SLP NO.
22283/18 AND ALSO REVIEW PETTETION NO.R.P[C] 1731/19 WHICH WERE DISMISSED AND
ORDERED TO IMPLIMENT and subsequently implimented to them who are party in
those cases.
Oflate hon’ble supreme court dismissed
one more SLP filed by the GOVT. AGAINST HONBLE HIGH COURT DELHI JUDGEMENT IN
WP.NO.[C] 10509/19DATED 23-1-20.
I would like to
bring to your kind notice that instead of issuing orders when hon’ble apex
court delivered judgement on policy matter,unfortunately govt did not issue
orders till date and on the other hand FINANCE MINISTER gave reply to one
question raised by HON’BLE MP IN THE LOKSABHA that it will be implimented to
those who approached the court of law.as such as there is no other way we
approached the court of law seeking justice and got the order.we request your
kndself to impliment the judgement to those who approached the court of law and
got favourable judgement without approaching to higher courts,as already higher
courts delivered same judgements and implimented to them.
If approached to higher court of law it will
be a financial loss to the Department and only implimentation will be delayed.
As such,I
request you to consider the issue keeping in view the natural justice and the
facts into consederarion and issue instructions to impliment the hon’ble CAT
HYD judgement and help the pensioners.
I hope you will respond
positively and take apropriate decesion early.a line in reply will be
appreciated.
