 In view of the fact that review Petition filed by UOI RP (C) NO. 2565/2015 in SLP (C) No. 6567/2015 UOI Vs M.O. Inasu dismissed by HSC on  28.8.2015,  and Following file notings of DOPW (obtained under RTI)let us hope DOP&PW will now issue necessary instructions extending benefit of full min. pension to all pre 2006 pensioners irrespective of Q.S. rendered.

12. It may be mentioned that in its order dated 22.1.2013 and 16.8.2013 in OA No. 715/2012 and OA No. 1015/2012 respectively, Hon’ CAT Ernakulam Bench directed that the revised pension fixed in terms of para 4.2 of OM dt. 1.9.2008 would not be reduced pro rata in cases where the qualifying service of a pre 2006 pensioner was less than 33 yrs. This order of Hon CAT was challenged by D/o Revenue  in the H.C. of Kerala in OP(CAT) No. 4/2012 and No. 8/2012. Hon’ H.C. of Kerala  dismissed the Op(CAT) No. 4/2012 and No. 8/2012 vide order dt. 7.1.2014. The SLP filed by the Dept. of Revenue against the order dt. 7.1.2014 has also been dismissed by Hon’ S/C. in its order dated 20.2.2015. Learned ASG, Sjri P.S.Narsimha has advised to file a Review Petition. The concerned file is presently with MOL(CA Section) and Ms. Rekha Pandey, Adv. is drafting the RP.

13. As already mentioned above, in the order dt. 29.4.2013 of Hon HC of Delhi in WP No. 1535/2012, it was observed that the only issue which survived was, with ref. to para 9 of OM dt. 28.1.2013 which makes it applicable from 24.9.2012 instead of 1.1.2006. In view of this observation of the Hon H.C. of Delhi, we may issue orders for giving effect to the OM dated 28.1.2013 w.e.f. 1.1.2006 instead of 24.9.2012. The question whether or not the revised pension in terms of OM 28.1.2013  would be  reduced proportionally would be examined once the order of the Hon S.C. in the RP to be filed against dismissal of SLP 21044/2014 is available  ( para 12 above)

6. Thus the court ruling has become law of the land

7. Given the fact the review/curative petition in the same matter has once been dismissed by Hon. Apex Court, as also the fact that Civil Appeal of Ministry of Defence with which the SLPs in question got tagged, has also failed, there is no chance  that a review petition may yield a different result. On the other hand this will not only engage the govt. machinery in uncessary litigation but will also result in attendant avoidable expenditure. Refixation of Pension to Pre-2006 Pensioners will be from 1.1.2006 but not including higher Grade Pay



Dear Comrades!

On my way to Shimla to attend the 2nd AIC of GDS NFPE, I am in New Delhi today. I had the opportunity to meet the Postal Board Member Personnel Shri.Ashutosh Tripathi along with Comrade R.N.Parashar Secretary General NFPE and Comrade Giriraj Singh the President NFPE today morning. As requested by the AIPRPA Tirunelveli Comrades, the Member P was requested to consider the mutual transfer case of Lady Doctor of Tirunelveli P&T Dispensary, who is retiring within a year. Member P assured to consider the issue. 

We had some interaction with the Officers of the Pension Branch of Postal Directorate and discussed about the Pre-2006 Pensioners refixation of pension issue. It is evident from the discussions that the application of higher Grade Pay to cadres like HSG-I etc from 1.1.2006 will not be applicable to Pre-2006 Pensioners and Family Pensioners as it is unless otherwise the DOPT takes a favourable stand on the issue as recommended by the Ministry of PEnsion & Pensioners Welfare and informed in the earlier SCOVA meeting.As per the 30th July Orders, it is made clear that the refixation of pension will be done from 1.1.2006 instead of from 24-09-2012 for all Pre-2006 Pensioners but the benefit of higher Grade Pay if any was granted to any cadre from 1.1.2006 like HSG-I, Postman / Mailguard etc will not be taken into account for refixation now. 

This was our fear also but we thought earlier that with the Supreme Court dismissing all wrongful orders of the Government issued subsequently to 1.9.2008, the issue of grant of higher GP also would be settled. But it is not the case and the long awaited full justice is still far away. Now we will get only the partial justice on the date of effect and on the interpretation of Pay in the Pay Band instead of Minumum of Pay Band.

AIPRPA CHQ HOLDING ITS AGM
 AT NEW DELHI ON 15-16 OCTOBER-2015

            Delhi State Association has made elaborate arrangements for holding the AGM in New Delhi on 15-16 October, 2015. 

            The AGM will be held in the Community Centre, R.K.Puram New Delhi.

            The Delegates stay accommodation is in the Vittal Complex opposite to AGM Venue.

            The Reception Committee has in addition to booking the accommodation for AGM and Delegates stay, has arranged for Momento Bags and engaged the big leaders including Shiv Gopal Misra (JCM Staff Side Secretary and AIRF GS); K.K.N.Kutty (Chariman Confederation and JCM Standing Committee Member); M.Krishnan (SG Confederation and JCM Standing Committee Member); R.N.Parashar (SG NFPE); D.Theagarajan (SG FNPO); Pavitra Ranjan Chakraborty (Offtg SG NCCPA); VAN Namboodiri (Patron NCCPA); K.G.Jayaraj (GS AIBDPA); General Secretaries of many All India Unions

            We hope that the recommendations of the 7th CPC will be submitted by 30th September, 2015, even though the Government had extended the period of Pay Commission by four months upto December, 2015. However, whether the report is  published before or not, we are holding the AGM as notified. 

            All CHQ Office Bearers, State General Secretaries, State Convenors of State Associations, District / Divisional Secretaries of AIRPA are Delegates to AGM.

            Other Comrades can also attend as Visitors to the AGM. 

            Good arrangements are being made by the Reception Committee for accommodation and catering and a reasonable delegates fee will be fixed by the reception Committee for delegates except the CMC Members. The Delegate fee has to be borne by the respective States / Districts. 

            The AGM is being held after the 1st AIC at Vellore. Many organisational aspects will be gone into deeply in the AGM besides deciding on a path to be pursued in future for achieving our important issues together with NCCPA and other Pensioners Organisations. 

            All are once again reminded to book their journey reservations to Delhi immediately. State General Secretaries and the State Convenors are requested to inform the CHQ and the Reception Committee about the probable number of Delegates / Visitors expected to attend the AGM to facilitate making arrangements for their stay without any hitch. 

            A detailed circular as well as the invitation will be directly sent to all CHQ Office Bearers and State Associations by the Reception Committee shortly. The State Association General Secretaries are requested to inform all their District / Divisional Secretaries the contents of the Reception Committee Circular as the CHQ and the Reception Committee are not in possession of the full mailing list of District / Divisional Secretaries of all States.

Department of Posts endorsed the Pre-2006 Pension Orders




The AIPRPA CHQ had intervened with the DG Department of Posts for early endorsement of Pension Ministry orders for refixation of Pre-2006 Pensioners and Family Pensioners. The above orders are now received in Head Post Offices after duly endorsed by respective level of offices. It can be seen that the endorsement orders are originally dated as 31-07-2015 but it is received and circulated only after our intervention through emails and letters.

Can We Expect 7th CPC Recommendations soon?

7th CPC may not delay its submission




Though Central Government decided to extend 4 months life of Pay Commission, it appears that it was in the background of negotiations with Armed Forces Veterans for referring OROP issue to CPC. Now in the background of across the table settlement of OROP, Govt too not issued any orders for time extn. CPC Chairman was averse to delaying his report. Comrade R.Elangovan DREU Working President analyses the situation nicely about possibilities of submission before 39.09.2015. I do agree with this assessment. More over the postponement of SCOVA meeting scheduled in September also indicates the probability of submission by end of September. 7TH CENTRAL PAY COMMISSION MAY SUBMIT ITS REPORT BEFORE 30TH SEPTEMBER 2015

1.Sri A.K. MATHUR,chairman ,7th cpc told the press on 24th August that he will submit his report before 30th September. 
2.Cabinet decided on 26th September to extend the tenure of 7th cpc up to 31-12-2015 which raised the suspicion that the submission of the report may be delayed.
3.But so far,until today, the finance ministry has not issued the extension order by notification.
4.The cabinet decision for extension was taken in the context of one rank one pension issue. The government wanted to refer the issue to 7th cpc.But the veterans did not agree to the suggestion. Now the issue has been settled outside the 7th cpc.Hence the need for the extension becomes unwarranted. It is why i think the finance ministry has not issued the extension order and the term as of now has ended on 27th August.7th cpc website also has not posted any extension of their tenure as no order exists for that.
5.Now cabinet has taken early decision on 1st july 2015 da so that the 7th cpc can include this da to evolve the formula for revision on 1-1-2016.You are aware that there will be no da on 1-1-2016 either of 6th cpc or of 7th cpc.
6.Government also has indicated the amount what is feasible and desirable to them through Arun jaitely’s medium term expenditure framework statement by suggesting an increase of about Rs 15000 crores which will be 25% of the basic pay. Even for 40% Rs 24000 cr is needed.Our demand is for 152% more over the existing 219%.Any increase can be possible out of the united struggle.Seriously prepare for the united struggle.
7.Under these circumstances i presume the 7th cpc may submit its report before or on 30th September 2015.

Sub: Inordinate delay in endorsing the orders of the Government by the DOP – regarding.
Ref: This Association’s letter of even number dated 20-08-2015

This Association is very much constrained to bring to your kind notice that despite bringing to the notice of the Postal Directorate, there appears to be some bottle-neck in the Postal Directorate in endorsing the orders of the DOPT and Ministry of Pension & Pensioners Welfare by the Department of Posts.

Please refer to the letter cited under reference in which the orders released by both the DOPT and the Pension & Pensioners Welfare Department pertaining to refixation of pension from 1.1.2006 itself for the Pre-2006 Pensioners was brought to your knowledge for causing to issue necessary endorsement by Postal Directorate. There appears to be no further action in the Postal Directorate and naturally there is absolutely no action at the field levels for re-fixing the pension to both Pre-2006 Pensioners and Family Pensioners.

The absence of endorsement by Postal Department despite the Government issuing the orders is really causing much resentment among the senior citizens who have toiled their full service life to the growth of Postal Services and to the members of Public. I request for your personal intervention in this urgent matter.

SCOVA Meeting Posponed by Pension Ministry

SCOVA POSTPONED

The 27th meeting of SCOVA (Standing Committee of Voluntary Agencies) which was earlier scheduled to meet on 29-09-2015 is now stands postponed due to Administrative reasons as per the orders of the Ministry of Pension & Pensioners Welfare. The order dated 7th September do not mention the postponed date of the meeting.
