Bureaucrats attempt to be-fool the Pensioners!

When will the Bureaucrats change their character?
Errors and Omission in the latest order dated 30th July

It seems the Indian Bureaucrats will never change themselves! Read the latest order of the Department of Pension & Pensioners Welfare dated 30th July 2015 on ‘Revision of pension of pre-2006 pensioners’ very carefully. It contains some erroneous statements and next it fails to incorporate the essence of another judgment of the Supreme Court regarding grant of full pension for pre-2006 pensioners with less than 33 years of service.

This latest order fails to mention the mistake committed in the clarification OM dated 3.10.2008 in the first paragraph. On the other hand the order wrongly says as though the clarification OM repeated the same thing as that of the original Para 4.2 of OM dated 1.9.2008. It fails to mention that clarificatory OM dated 3.10.2008 had actually twisted the words “pay in the pay band” into “minimum of the pay band”! One who reads the latest order will naturally get confused as to what is the difference between the original OM dated 1.9.2008 and the clarificatory OM dated 3.10.2008 against which six years of legal battles were being waged by the Senior Citizens?

Similarly the latest order again distorts the nature of the prayers by Petitioners in the CAT. The prayer in the CAT was for demanding fixation of pension to pre-2006 pensioners was to cancel the clarificatory OM’s contention of “Minimum of the Pay Band” and uphold the “Pay of the Pay Band plus the Grade Pay appropriate to the pre-revised pay scale” read with the fitment table annexed to the MOF, DOE OM as recommended by the 6th CPC. But the latest order distorts the prayers of pensioners and says as though the pensioners in the CAT had demanded only what was wrongly stated in the clarificatory OM dated 3.10.2008 instead of the original OM dated 1.9.2008!!

Even though the Para 4 of the latest order dated 30th July practically solves the problem faced by pre-2006 pensioners by changing the date of effect of OM dated 28-01-2013 with effect from 1.1.2006 instead of 24-09-2012, it can be seen that this order is drafted in such a nasty manner. What is the meaning of that? Are the bureaucrats are foolish enough to fail to understand the difference between the original OM and the clarificatory OM? If so they are fools. But they are not fools because they are trying to make the lakhs of pensioners look like fools? One thing is sure. The Indian Bureaucrats will never change their character even on the face of repeated blows they receive at the hands of the Judiciary.

Secondly, it can be seen that while the Para 4 of this latest order set rights the problem of fixation of pension of pre-2006 pensioners as per the original OM dated 1.9.2008, it refuses to incorporate the essence of another Supreme Court verdict upholding Kerala High Court and the CAT Ernakulam Bench viz., to grant full pension to pre-2006 pensioners with less than 33 years of service in the light of the fact that the Para 4.2 never mentions about pro-rata fixation of pension to pensioners with less than 33  years of service. This also shows the mindset of the Bureaucrats and the Government that they do not want to honour the judgments of the highest court of the land.  This is the character of the Indian Bureaucracy that never wants to bow its head before anything including the Apex Court! When will they change for the better? We do not  know!

This Association is writing to the Minister concerned about the above facts for effecting necessary corrections in the latest order.

CENTRAL GOVT. PENSIONERS ALL INDIA CONVENTION AT SUNDARAYYA VIGNANA KENDRAM, HYDERABAD ON 31ST JULY 2015 ORGANISED BY NCCPA

NCCPA National convention of CG Pensioners commenced today at 11.00 Hrs in Sundarayya Vignana Kendra Hyderabad under the chairmanship of com.Raktod Vice President of NCCPA. Comrade AKP National President of CITU inaugurating the convention. A plethora of leaders including Patron com.Shiv Gopal Misra; Confederation Chairman com.KKN; NCCPA SG com.Pavitra Ranjan Chakroborti; Defence employees leader com.Pathak; AIBDPA GS com.Jayaraj; AIPRPA GS K.R are present on dais.

CHERISHABLE VICTORY OF PRE-2006 PENSIONERS

PRE-2006 PENSIONERS WIN AFTER

LONG BATTLE BUT BATTLE NOT OVER

The Central Government has ultimately bowed before the verdict of the Apex Court on the matter of fixation of pension for Pre-2006 Pensioners as recommended by the 6th CPC from 1.1.2006. after dilly dallying on this matter for six long years and dragging the pensioners to various courts again and again under different petitions, the orders of the Pension & Pensioners Welfare Ministry has released the orders on 30th July.

As per this order, those pre-2006 pensioners whose pension fixed as on 1.1.2006 shall be as per the recommendation of the 6th CPC and as ordered originally by the Government on 1.9.2008. viz., not less than 50% of the Pay in the pay band plus appropriate Grade Pay. The interpretation given by the Under Secretaries of Government of India later to change the above contention of Pay in Pay Band into Minimum of the Pay Band only had been quashed by the Principal Bench CAT of Delhi but the Government unnecessarily dragged the matter for six long years in the higher  courts of law. At some point of time during the legal battle, sensing the defeat before the Courts, the Governemnt had issued order to correct its mistake from 24-09-2012 instead of from 1.1.2006. After some time the Government issued orders implementing it from 1.1.2006 only for S-29 Scale Pensioners, and not giving it for other pensioners. Now, ultimately, the justice has prevailed on this matter with the release of the following orders of MOP&PW dated 30th July. However, we can see that the decision of the Supreme Court on another issue viz., grant of the same benefit of full pension for Pre-2006 Pensioners retired with less than 33 years of full qualifying service has not been incorporated in this order, leaving further need of legal battles by the  Pre-2006 Pensioners retired with less than 33 years of service. Battle is not yet over for the Pre-2006 Pensioners with less than 33 years of service.

The latest orders are reproduced here:

REVISION OF PENSION OF PRE-2006 PENSIONERS - REG

EDITORIAL POSTAL CRUSADER: AUGUST-2015

DEFEAT ANTI PEOPLE, ANTI WORKING CLASS POLICIES OF THE CENTRAL GOVERNMEN.

MAKE THE ONE DAY STRIKE ON 2ND SEPTEMBER-2015 A HISTORIC SUCCESS.
*****************
During the one year period of BJP Government, it may be clearly felt that this Government has betrayed and cheated the workers and worked against them curtailing  their trade union rights, wages and social security’s which were earned through sustained struggles and sacrifices by them. Every action of Government is pro capitalists, pro employers. Large scale amendments in labour laws are aimed to benefit industrialists/employers to give them free hand to retrench/lay off workers, declare closure/shutdown of establishment and resort to mass scale contractorization.

The main object of these changes is to do away with whatever minimal protection the workers are having under present labour laws despite their large scale violations in connivance with the state Governments. The present Central  Government  does not  want to implement the consensus recommendations of 43rd, 44th and 45th Indian Labour  Conferences of formulation of minimum wages, same  wage and  benefits as regular workers for the contract  workers and granting  status of workers with attendant benefits to those employed in various Central Government schemes like Anganwadi, Midday Meal, ASHA, Para Teachers etc. On the contrary the Government drastically curtailed budget allocations to all those centrally sponsored schemes meant for poor people’s welfare.

Beside these labour laws the Central Government is also doing away the workers from social security schemes like, EPF and ESI making them a optional aiming to dismantle the basic social security cover available to organized sector.
The Government has not taken any concrete measures to curb price rise of essential commodities. On universal public distribution system, the Government is trying to scuttle it through Direct Benefit transfer scheme resulting further squeeze on the common people,
After coming in Power this Government declared total Ban on recruitment in all Central Government Services causing large scale unemployment. 100% FDI in Railways, the biggest establishment of Central Government has been declared and further projects will be launched on PPP Model. Bigger and important stations will be given to private  parties to develop and take  users charges causing more burden on common man.49% FDI  has also been declared in Defence and 41 Ordnance Factories  will be privatized resulting more contractorization  of labour . Disinvestment has already been started in C.P.S.U.S. like Coal India Ltd., NTPC and NHPC etc. Plan to corporatize Ports is also in pipeline.

Whatever promises were made by Modiji during election campaign. On all of those this Government has taken U turn. Not a single promise is being fulfilled. Land acquisition act is also being amended which will be against the interests of Farmers. No reasonable minimum support price for the agriculture products and nothing to compensate the loss of crops caused due to natural calamities.

In Central Services the New Pension Scheme  was introduced  during the previous NDA Government and now this Government  also does not agree to replace it by Defined benefit Pension Scheme causing more miseries to the working people,

The demands of Central Government Employees for grant of DA Merger, Interim Relief and date of effect of 7th CPC recommendations from 01.01.2014 has also been rejected.

In Postal Department, Government is moving ahead to corporatize various services based on the recommendations of Task Force Committee headed by T.S.R Subramanian. The Department of Posts and Government of India has still not taken any decision to include G.D.S. in 7th CPC. The agreement and assurances made by the Postal Board during the course of negotiations on PJCA Strike Charter of Demands are not being implemented.

So keeping all the facts in mind and in pursuance of decision taken by All Central Trade Unions to go on ONE DAY STRIKE on 2nd September-2015 , the National Executive of Confederation and Federal Secretariat of NFPE  have  also endorsed the decision to resist the onslaughts on working class in the wake of neo-liberal Economic Policies by participating in the strike.

NFPE appeals to all the affiliates and entire rank and file to make maximum efforts for the grand success of ONE DAY 2nd September-2015 Strike and defeat Anti People, Anti Working Class Policies of Government of India.
