NAGABHUSHANAM ON IMMEDIATE SANCTION OF CGHS ADMINISTRATIVE OFFICE IN AP STATE WITH BRANCHES AT VISAKHAPATNAM & TIRUPATHI AND OPENING OF CGHS WELLNESS CENTER IMMEDIATELY AT VISAKHAPATNAM WHICH WAS ALREADY SANCTIONED AND IMMEDIATE COMMENCEMENT OF AIIMS AT MANGALAGIRI WHICH WAS ALREADY ANNOUNCED SO THAT PENSIONERS WILL GET CASHLESS TREATMENT FECILITY.


Bureaucrats attempt to be-fool the Pensioners!

Errors and Omission in the latest order dated 30th July


It seems the Indian Bureaucrats will never change themselves! Read the latest order of the Department of Pension & Pensioners Welfare dated 30th July 2015 on ‘Revision of pension of pre-2006 pensioners’ very carefully. It contains some erroneous statements and next it fails to incorporate the essence of another judgment of the Supreme Court regarding grant of full pension for pre-2006 pensioners with less than 33 years of service.

This latest order fails to mention the mistake committed in the clarification OM dated 3.10.2008 in the first paragraph. On the other hand the order wrongly says as though the clarification OM repeated the same thing as that of the original Para 4.2 of OM dated 1.9.2008. It fails to mention that clarificatory OM dated 3.10.2008 had actually twisted the words “pay in the pay band” into “minimum of the pay band”! One who reads the latest order will naturally get confused as to what is the difference between the original OM dated 1.9.2008 and the clarificatory OM dated 3.10.2008 against which six years of legal battles were being waged by the Senior Citizens?

Similarly the latest order again distorts the nature of the prayers by Petitioners in the CAT. The prayer in the CAT was for demanding fixation of pension to pre-2006 pensioners was to cancel the clarificatory OM’s contention of “Minimum of the Pay Band” and uphold the “Pay of the Pay Band plus the Grade Pay appropriate to the pre-revised pay scale” read with the fitment table annexed to the MOF, DOE OM as recommended by the 6th CPC. But the latest order distorts the prayers of pensioners and says as though the pensioners in the CAT had demanded only what was wrongly stated in the clarificatory OM dated 3.10.2008 instead of the original OM dated 1.9.2008!!

Even though the Para 4 of the latest order dated 30th July practically solves the problem faced by pre-2006 pensioners by changing the date of effect of OM dated 28-01-2013 with effect from 1.1.2006 instead of 24-09-2012, it can be seen that this order is drafted in such a nasty manner. What is the meaning of that? Are the bureaucrats are foolish enough to fail to understand the difference between the original OM and the clarificatory OM? If so they are fools. But they are not fools because they are trying to make the lakhs of pensioners look like fools? One thing is sure. The Indian Bureaucrats will never change their character even on the face of repeated blows they receive at the hands of the Judiciary.

Secondly, it can be seen that while the Para 4 of this latest order set rights the problem of fixation of pension of pre-2006 pensioners as per the original OM dated 1.9.2008, it refuses to incorporate the essence of another Supreme Court verdict upholding Kerala High Court and the CAT Ernakulam Bench viz., to grant full pension to pre-2006 pensioners with less than 33 years of service in the light of the fact that the Para 4.2 never mentions about pro-rata fixation of pension to pensioners with less than 33  years of service. This also shows the mindset of the Bureaucrats and the Government that they do not want to honour the judgments of the highest court of the land.  This is the character of the Indian Bureaucracy that never wants to bow its head before anything including the Apex Court! When will they change for the better? We do not  know!

This Association is writing to the Minister concerned about the above facts for effecting necessary corrections in the latest order.

NCCPA NATIONAL CONVENTION OF CG PENSIONERS AT HYDERABAD A GRAND SUCCESS

NCCPA National Convention held on 31st July

The National Convention of CG Pensioners organised by the NCCPA and hosted by the Telengana State Pensioners & Retired Persons Association in Sundarayya Vignana Kendra at Hyderabad was presided over by Nagpur CGPA leader Comrade Daktod. Comrade Prabhakar Nair leader of the host organisation welcomed all participants. Large number of delegates from several states participated in the convention including three women delegates. AIPRPA's participation was significant with 100 Delegates from 8 States including two women delegates from Kerala. 

Comrade A.K.Padmanabhan CITU National President inaugurated the convention with his remarkable speech covering the international and national attacks on working class including the Pensioners and Senior Citizens under the neo-liberal policies and the need to unite to carry forward the struggle against these policies. He also narrated the importance of 2nd September strike by all sections of working people in India. 

Comrade Shivgopal Misra the General Secretary of AIRF and the Patron of NCCPA delivered his special address. His speech covered the important issues before the Pay Commission including that of the pensioners and the need to go on strike from 23rd November. He also pointed out the privatisation spree of the Central Government and he warned that the indefinite strike of November will be preponed without any notice if the Government tries to implement the privatisation of Railways as per the recommendations of Dr.Bibek Debroy Committee. 

Comrade Pathak Presidenet of the AIDEF also narated the issues before the CG Employees and Pensioners and the policies of the GOI that are aimed at supporting the Corporates and MNCs. He urged for united struggle of all to meet the dangers.

Comrade KKN Kutty President of Confederation of CG Employees delivered his special address and pointed out that all should understand the political game of the Government and should be ready to counter it effectively. He touched the issues of Pensioners but called for a larger unity of all pensioners and employees to successfully meet the situation. 

Comrade Pavitra Ranjan Chakraborti the Officiating SG of NCCPA presented the Draft Declaration of the Convention and addressed on the important points in the Declaration. 

In the afternoon session Comrades K.G.Jayarajan GS AIBDPA; K.Ragavendran GS AIPRPA; P.C.Nair GS Para-military Pensioners Association; and many other leaders also addressed the session and covered the Draft Declaration presented before the house by the Secretary General and suggested several improvements and modifications. 

Delegates representing the Affiliated organisatins of NCCPA deliberated on the Draft Declaration and all supported the Draft Declaration and suggested some improvements. 

The Convention came to an end with the summing up speech of the Secretary General. The Convention has taken important decisions including to organise solidarity action by Pensioners in support of 2nd September Strike in all places according to local conditions; solidarity programmes to CG Employees strike from 23.11.2015; continuous campaign programmes and conventions for popularising the demands of the Pensioners as finalised by the Convention; taking steps for meeting the situation by all Pensioners Organisations unitedly after the submission of recommendations of 7th CPC etc. 

The National Convention was a grand success and all participants have returned with enthusiasm and determination. Some Photos of the Convention are placed below:
